Research on the constitutive facts of crime
Abstract: Modern theory of the constitution of crime in criminal law is develop on the basis of the fact of criminal act, but, the constitutive facts of crime, which is important to criminalization and measurement of penalty, is not given much concern in research and is confused with facts of crime and the fact of crime that confirms to constitutive elements and even constitution of crime. This paper tries to make clear distinction among these problems and discusses the status of the constitutive facts of crime in criminal law. The author approves than the constitutive facts of crime is the grounds of criminal liability and proposes that the constitutive facts of crime is the objective substance base of the logical relation between criminalization and measurement of penalty. It is important to criminal prosecution and judicial adjudication and is conjunction between the protective function and the guarantee function of the criminal law. In the end, the paper suggests that we should clearly investigate the constitutive facts of crime to ensure justice of criminal prosecution.
